Lawsuit filed against Clear Lake School District will go to trial in 2016

A lawsuit filed by the mother of an injured Clear Lake football player against the Clear Lake Community School District has been set for March 15, 2016.

A court scheduling order filed Thursday states the trial is expected to last four to five days.

Roxanne Hasfjord filed the lawsuit on behalf of her son, Austin, in Cerro Gordo County District Court.

According to court documents, Austin suffered a serious head injury while participating in school-sponsored football Sept. 18, 2012. The lawsuit claims the injury was allegedly exacerbated during practices and games in the following weeks. The lawsuit claims the school district was negligent because it failed to investigate and monitor the injury and allowed him to participate in football practices and games.

Hasfjord is seeking damages on her son’s behalf for past and future medical expenses, pain, suffering and partial disability. The lawsuit also seeks to recover damages for loss of consortium as a result of the exacerbation of Austin’s injury.

Hasfjord is seeking an unspecified amount. A jury trial has been demanded.
